Terms of Use
1. Agreement
These Terms are a contract between you and VioVoice ("we", "us") about your use of Chatty, our messaging and calling service. By creating an account or using Chatty you agree to them and to our Privacy Policy. If you do not agree, please do not use Chatty.
You must be at least 13 years old to use Chatty. To buy credit you must also be old enough to make a binding contract where you live.
2. Your account
Give us accurate information, including a phone number that you own or are allowed to use. Keep your password private. You are responsible for what happens under your account, so tell us at once at info@viovoice.com if you think someone else has got in. One account is for one person.
3. What you may not do
- Break the law, or use Chatty to harass, threaten, defraud or impersonate anyone.
- Send spam, unwanted bulk messages, or unsolicited sales or robocalls.
- Share sexual content involving children, or any content that exploits or endangers a child. We report this to the authorities.
- Upload malware, or try to break, overload, probe or get around the security of Chatty or other people's accounts.
- Collect other people's information from Chatty by automated means, or resell access to Chatty.
- Use calling for fraud, for premium-rate or toll-fraud schemes, or to reach numbers we block.
We may remove content, limit features, or suspend or close accounts that break these rules or that put others or the service at risk.
4. Your content
You own what you send. You give us permission to store, copy and deliver it, only as needed to run Chatty for you and the people you talk to. You are responsible for your content and for having the right to share it.
Messages are not end-to-end encrypted. They are protected on their way to and from our servers, but they are stored on our servers so they can reach your other devices, which means we can technically access them. Do not use Chatty for anything that needs that level of secrecy.
Disappearing messages are deleted from our servers when their time is up, but anyone who received a message could already have copied, forwarded or photographed it. We cannot prevent that.
5. Calls and credit
Calls to ordinary phone numbers are paid for with prepaid credit. The price is shown before you call and calls are charged as described in the app. Credit is not money in a bank account: it cannot be withdrawn, transferred or exchanged for cash. Unused credit is not refunded except where the law requires it, or if we close your account without a breach of these Terms on your part, in which case we will refund what is left where we reasonably can.
Payments are handled by Stripe and PayPal under their own terms. We never see your full card number. If a payment is reversed or disputed, we may take that amount back from your credit or suspend your account.
Chatty is not a replacement for a phone line and cannot place emergency calls. Do not rely on it to call 911 or any other emergency service. Call quality depends on your internet connection, and some destinations may be unavailable or blocked.
6. Third-party services
Chatty uses other companies' services, for example to take payments, carry calls to phone numbers and deliver notifications. Their terms apply to the parts of the service they provide, and we are not responsible for their failures.
7. Ending your account
You can stop using Chatty at any time and delete your account in Settings. What happens to your information is explained in the Privacy Policy. We may suspend or end your access for the reasons in section 3, for legal reasons, or if we stop offering Chatty. We will give notice where we reasonably can.
8. No warranty, and limits on our liability
Chatty is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or that messages and calls will always be delivered. To the fullest extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability to you for any claim about Chatty is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some places do not allow these limits, so they apply only as far as the law permits. Nothing here limits liability that cannot be limited by law.
9. Governing law
These Terms are governed by the laws of the State of New York and applicable US federal law, without regard to conflict-of-law rules. Any dispute that cannot be settled informally will be brought in the state or federal courts located in New York County, New York, and you and we agree to those courts. Consumer protection rights that cannot be waived where you live still apply.
10. Changes
We may update these Terms. When the changes are important we will tell you in the app or by another reasonable means. If you keep using Chatty after the new date at the top, you accept the changes.
